2257 Summary Judgement issued
US District Judge Miller handed down a summary judgment yesterday further strengthening the government’s position identifying website affiliates as subject to the 2257 regulations. Any webmaster in the US should be watching this case CLOSELY as it is going to affect the way you do business - getting prepared is never a bad thing!
One interesting change is that although you must have 2257 documents, the ones you as a secondary producer have on file may have everything except the date of birth redacted (that is to say obscured) which does eliminate the #1 argument from many sponsors that giving out the 2257 documents exposes their models to potential harm. I agreed with that statement, btw - but since sponsors no longer have to provide the address, etc. it’s now pretty much a moot point.
If you haven’t already, this is the time to start centralizing the images you use on your blogs/websites and getting those 2257 files together, as the government can start auditing you after May 1st, 2007 assuming no further challenges are posed - but I’d bet my bottom dollar further challenges WILL be posed until no further avenues remain.
